(1) According to paragraph 3 of article 14 of EDP's By-Laws, votes from a shareholder owning category A shares exercise on its own account or on behalf of another shareholder, shall not be cast in the event that they exceed 5% of the total votes corresponding the total share capital.
(2) In compliance with the understanding imparted by the CMVM to Sonatrach in relation to the effects of a shareholder agreement entered into with the shareholders Parpública – Participações Públicas, (SGPS) S.A. and Caixa Geral de Depósitos S.A., the voting rights corresponding to the stock held by these two shareholders have been assigned to Sonatrach since 11 April 2007, pursuant to Article 20 nº1 of the Portuguese Securities Code.
